Trenk Isabel Siddiqi & Shahdanian’s Bankruptcy and Corporate Restructuring practice group handles in and out-of-court restructurings, state and federal insolvency proceedings, and bankruptcy litigation.
Our attorneys represent debtors, creditors and other statutory committees, secured lenders, landlords, tenants and contract parties, equity holders, creditors, vendors, trustees, receivers, and asset purchasers. The team has handled Chapter 11 real estate, manufacturing, retail, and non-profit cases involving midsize entities to those with assets of more than $500 million in value.
Debtor Representation
When representing debtors, we work with company management and advisors from the inception of the case through its closing. Our attorneys have successfully resolved cases through restructuring, sales or other resolutions in industries including construction and landscaping, food services, healthcare, non-profit, transportation, and retail.
We work diligently to ensure a successful resolution of all cases in an expeditious and cost-effective manner.
Creditors’ Rights
In the area of creditors’ rights, we work aggressively for our clients to expeditiously recover debt to maximize outcomes and preserve value. Our attorneys have experience representing creditors in connection with preference and fraudulent transfer claims, commercial loan workouts, foreclosure and debt-instrument litigation, tax sale foreclosures, judgment enforcement, collateral recovery, and other insolvency-related matters.
Litigation
We represent clients involved in bankruptcy litigation in federal courts, on issues including contested plan confirmations, sale motions, relief from the automatic stay, substantive consolidation, and other litigation involving affiliates, non-dischargeability actions, and prosecution and defense of claims against directors and officers.
Fiduciary Representation
We have significant experience representing all types of court-appointed fiduciaries, including Chapter 7 and 11 trustees, state and federal court receivers, and special fiscal agents. Our attorneys work collaboratively to ensure that each fiduciary maximizes value. In addition, our attorneys have served as fiduciaries in state and federal court.
