Trenk Isabel Siddiqi & Shahdanian PC Succeeds in Appellate Division Matter on Behalf of the City of Hoboken

On February 10, 2026, the Superior Court of New Jersey Appellate Division issued its decision in the matter of Hoboken Municipal Employees Association v. City of Hoboken (Docket No. A-1874-24), on appeal from the Superior Court of New Jersey, Law Division. Trenk Isabel Siddiqi & Shahdanian PC director Asaad K. Siddiqi and associate Valentina M. Scirica briefed the argument on behalf of the City of Hoboken in a matter rising from a collective bargaining agreement and involving an arbitration award. The Appellate Division affirmed the trial court’s decision to vacate the arbitration award, but reversed the portion of the order that modified the award and remanded the case for further proceedings consistent with the arbitration statute.

Siddiqi explained, “While the Appellate Division agreed that the arbitrator exceeded her authority by concluding the City had discretion to unilaterally set the salary and benefits of employees rehired from the special reemployment list, the court held the trial court went too far by modifying the award itself and clarified that, once vacated, the matter must proceed under the statutory framework governing arbitration. This is the outcome we were hoping for on appeal, as it returns the matter to the arbitrator for any modification, if appropriate.”
